91.1 Offences involving drug consumption and influence  
  Offences involving the consumption and influence of drugs is when persons consume drugs against rules of public safety and the safety of children and others.  
 
 Primary Fact(s)
 1. That the accused was arrested on suspicion of being intoxicated under the influence of drugs;
 2. That lawful regulations exist regarding the safe consumption of drugs in public;
 3. That upon testing the accused, their test results did breach the lawful limit for safe drug consumption.

b) Consumption of nasally consumed narcotic drugs in a public place;

a) Consumption of narcotic smoking drugs in a private place in the presence of children under the age of 14 years;
b) Consumption of injected narcotic drugs in a public place;
 
 
 Penalty Conditions (Level 3-Crime)
