1. Introductory provisions
 
  Article 03-Jurisdiction of the Military code  
3.1 Persons to whom the Military code applies  
  This Code shall apply to any person who is a temporary or permament member of the armed forces of African Union, any person who is providing a temporary or permanent service to the armed forces and/or any person who is currently held as a prisoner of the armed forces of African Union.  
3.2 The Operation of Military Judicial Code of African Union  
  Any military action required by law to be brought before a Judge and Court of African Union shall be conducted under this Code.  
  This Code shall be the one single document to which all Military Courts defer in relation to the proper procedure and conduct of all military disciplinary action.  
3.3 The Operation of Military Law in Respect of Persons Who Have Committed Offences in the Territory of African Union  
  Any person to whom the military code applies who has committed an offence in the territory of the African Union shall be brought to military responsibility under this Code.
 
  Offences committed within the limits of the territorial waters or the air space of the African Union shall be deemed to have been performed in the territory of the African Union. The validity of this Code shall also be extended to offences committed on the continental shelf and in the exclusive economic zone of the African Union.
 
3.4 The Operation of Military Law in Respect of Persons Who Have Committed Offences Outside the Boundaries of the African Union
  Any armed forces personnel who are temporarily or permanently stationed outside the territory shall be brought to military responsibility under this Code.
 
  Any prisoners of the armed forces of African Union who are temporarily or permanently in custody outside the territory shall be brought to military responsibility under this Code.
